Booking Terms and Conditions

1. Contract Terms

These terms constitute the full contract between FOMO Adventures Travel Pty Ltd (“FOMO Adventures,” “Us,” or “We”) and the customer (“You” or “Passenger”) based on the terms below, as well as the terms of any third-party Service Providers included in Your travel arrangements. Each Service Provider may have unique terms and conditions that apply to Your trip. For further information, please contact the Service Provider directly.

2. Inclusions and Exclusions
   
   

2.1 Inclusions
The following items are included in Your FOMO Adventures booking:

• All listed accommodation and night stays
• Bus transport as specified
• Listed activities and tours
• Meals as indicated in Your itinerary: (B) = Breakfast, (L) = Lunch, (D) = Dinner.

2.2 Exclusions
The following items are not included in Your booking:

• Travel insurance (compulsory)
• Personal expenses
• Meals not specified in the itinerary
• Deposits for rental equipment
• Shuttle services not included by accommodation providers
• Public transport, taxis, trains, or other transit You choose independently
• Accommodation outside Your FOMO Adventures booking (pre- or post-trip).

2.3 Additional Activities
If You have purchased Add-On Activities, the itinerary will specify the days these activities occur. For additional activities, contact Us or Your FOMO Adventures representative, who can assist in booking these experiences.

3. Travel Insurance
   
   

3.1 Requirement
Travel insurance is mandatory when traveling with FOMO Adventures and must cover accidents, illness (including COVID-19), lost items, and missed tours. It should also include:

• Accidents, injury, illness, and death
• Emergency repatriation (e.g., helicopter rescue, air ambulance)
• Personal liability
• Trip cancellation, loss of luggage, and natural disasters.

FOMO Adventures is not responsible for any lost personal items. We recommend choosing an insurance policy with a low excess for canceled tours.

4. FOMO Adventures Cancellation Policy
   
   

4.1 Entire Trip Cancellation
If You cancel Your entire booking, the following applies:

• 150 days or more before departure: Full refund minus deposit.
• 30-149 days before departure: 50% refund minus deposit.
• Less than 30 days before departure or after: No refund.

4.2 Partial Trip Cancellation
If You leave the tour after it has commenced, the remainder of the tour will be non-refundable. We will, however, provide a statement for Your insurance claim.

4.3 Cancellations by Third-Party Providers

• If a third-party provider cancels due to operational issues, We will find an alternative or offer a refund.
• In cases of cancellation due to natural disasters, epidemics, or government travel restrictions, We will provide a statement for Your insurance claim.

4.4 Add-On Activity Cancellations
If weather conditions cause cancellation of an Add-On Activity, We will attempt to reschedule or find an alternative. If unavailable, You will be refunded for that activity.

5. Your Responsibilities
   
   

5.1 General Responsibility
FOMO Adventures will arrange Your accommodations, transportation, and activities. However, it is Your responsibility to arrive on time at designated locations. Missed activities or transport are non-refundable, and You will be responsible for additional travel arrangements if You miss a connection.

5.2 Dietary Requirements
Please inform Us of any dietary requirements or allergies upon booking so that We can accommodate them where possible.

6. FOMO Adventures Standard Terms
   
   

6.1 Published Information
FOMO Adventures strives to maintain accurate information regarding itineraries and schedules but is not liable for any loss arising from delays due to external factors. Updated brochures or online details override previous versions.

6.2 Disruptions
FOMO Adventures is not liable for disruptions beyond Our control (e.g., weather, natural disasters). Comprehensive travel insurance covering these disruptions is advised.

6.3 Sickness & Injury
While We coordinate with reputable suppliers, FOMO Adventures is not liable for any sickness or injury.

6.4 Visas
You are responsible for having a valid passport and appropriate visas during travel.

6.5 Illegal Activity
FOMO Adventures reserves the right to terminate Your booking without refund if You engage in illegal activities, including the use of illegal substances.

6.6 Photography & Media
FOMO Adventures occasionally captures media for promotional purposes. You have the option to opt out by notifying Us. If You do not opt out, You consent to FOMO Adventures using images taken during Your trip royalty-free worldwide.

6.7 Behaviour
Disruptive or abusive behavior toward fellow travelers, staff, or Service Providers will not be tolerated. FOMO Adventures reserves the right to terminate travel without refund for passengers engaging in such conduct.

6.8 Minimum Numbers
Certain experiences require a minimum number of participants. If minimum numbers are not met, an alternative option will be offered, and You will be notified at least 48 hours in advance.

7. Privacy
   
   

7.1 Information Sharing
FOMO Adventures will not share Your personal information except under the following circumstances:

• Travel Group Chat: Your WhatsApp number may be shared with group members.
• Service Providers: Your email may be shared with third-party providers for waivers or confirmations.

8. Data Protection
